What is a Construction Delay?
I’m Chad Walker and I’m a partner with Regan Atwood, a Florida law firm with offices in Orlando and Jacksonville.
I’m going to talk about the services we provide to clients relating to construction delays or other impacts to the performance of their work. Our experience with delays and other productivity impacts exemplifies the range of our construction law practice. Often, we’re asked to get involved early in the project to counsel the client at the time of contract.
Assistance With Reviewing Contract Terms
We may assist with reviewing critical contract terms including provisions that govern time extensions and compensation for impacts. We might be asked to negotiate some of those critical terms with the other party.
When a delay occurs on a project, we’re often asked to step in and assist our clients in preserving their rights. Notice and claim provisions, as many of you know can be complicated and confusing at times.
Counseling Clients Through the Process
We counsel our clients through the process of preserving and asserting their request for time extension and or their requests for additional compensation. When a delay is not resolved through the claim process, we represent clients in litigation or arbitration.
We have experience with successfully resolving construction claims in jury and non-jury trials, as well as an arbitration.
